This session will provide an overview of several different types of fraud and the issues and methodologies associated with investigating them.  The types of fraud covered will include financial reporting, misappropriation of assets and corruption.  The speakers will discuss the roles and responsibilities of lawyers, accountants and other third-parties involved in an investigation as well as corporate governance and legal implications for involved parties.  The speakers will share lessons learned from performing such investigations and discuss best practices from the initial stages of an investigation to its conclusion.

Jimmy S. Pappas

Grant Thornton, Partner - Forensic Advisory Services

 

Jimmy advises legal counsel, management, and boards of directors on accounting, internal control, and financial matters in the context of internal investigations, civil and criminal litigation, business disputes and corporate governance initiatives. He has over twenty years of experience in the forensic and audit disciplines of accounting and has served clients, including Fortune Global 500 companies, internationally.

Jimmy has conducted corporate internal investigations on issues relating to the integrity of financial statements, corruption, and misappropriation of assets. His work in this area is often in response to regulatory inquiry. He also advises clients on anti-fraud and anti-corruption compliance programs.

In addition, he has consulted as an accounting/audit/damages expert on disputes adjudicated in federal courts, state courts and international venues. He has testified as an accounting expert on behalf of regulatory agencies such as the US Securities and Exchange Commission, has been engaged as a consulting expert by defendants in criminal securities fraud litigation initiated by the US Department of Justice, and has advised plaintiffs and defendants in commercial disputes involving damages and valuation issues.

Jimmy frequently speaks on compliance and regulatory matters at international conferences. The American Institute of Certified Public Accountants Governing Council twice elected Jimmy to three-year terms on the Joint Trial Board, the Institute’s adjudicatory/disciplinary body. In addition, the Association of Certified Fraud Examiners has appointed him to its Advisory Council. Jimmy also serves on the Board of Directors of the New England Legal Foundation, a non-profit public interest law firm.

 

 

Stephen A. Jonas

Partner Hale and Dorr,Co-Chair, Investigations and Criminal Litigation Practice Group

Stephen A. Jonas is co-chair of the firm's Investigations and Criminal Litigation Practice Group. His practice focuses on representing corporations and individuals in investigations and criminal defense and grand jury matters. Mr. Jonas' work includes the full range of representation of clients in this area from internal corporate investigations to grand jury representation to criminal trials and appeals. He has represented clients in jurisdictions around the country, as well as in cross-border investigations. Mr. Jonas also handles related False Claims Act cases, government enforcement proceedings and civil litigation. He has substantial experience in the areas of healthcare fraud, immigration fraud, accounting fraud, securities fraud, economic espionage and environmental crimes. Mr. Jonas also has experience in the unique issues of representing corporate and outside legal counsel in government investigations. Mr. Jonas joined Hale and Dorr in 1984. In 1988, Mr. Jonas was appointed Deputy Attorney General and Chief of the Public Protection Bureau of the Massachusetts Attorney General’s Office, which handled all of the Commonwealth’s environmental, civil rights and consumer enforcement investigations and litigation, as well as its nuclear plant safety and asbestos property damage litigation. Mr. Jonas rejoined the firm in 1991.
